Collection of personal information
The kinds of personal information we collect about you and how we use it is dependent on the nature of our relationship with you and the purposes of collection.
We may collect your:
Full Name;
Date and place of birth;
Residential or business address;
Email address and telephone number;
Government-issued identification details, such as driver's licence, passport, Medicare or other ID document numbers;
Biometric information, such as a facial image or short video used to verify your identity;
References (in relation to rental arrangements and job applicants);
Financial information (such as bank details for the purposes of transferring the balance of a deposit amount or marketing refunds);
Ownership or control information about legal entities that you own or are affiliated with (if applicable), including evidence of beneficial ownership;
Evidence of the sources of your funds or wealth;
Information that helps us to determine the nature and purpose of your transaction.
We may also collect non-personal information associated with you such as the details of the products or services you have enquired about, your occupation, property value, rental amounts, insurance details, references (in relation to rental arrangements and job applications).
How we collect personal information
Generally, we collect your personal information directly from you unless it is impracticable or unreasonable to do so. We may collect personal information from you in person (e.g. if you are attending an open house inspection), online via forms we use to process enquiries or applications, or through a physical application you make.
We may also collect personal information about you from third parties (for example, from your representative, from publicly available sources, from Harcourts Australia and other Harcourts Australia franchisees, or from your referees where you apply for a rental property or a position with us).
If you provide us with personal information about a person that you represent, we collect it on the basis that you have that person's consent for us to collect and handle their personal information in accordance with this Privacy Policy.
If you choose not to provide some or all of the personal information that we request, we may not be able to assist you fully, to the same standard or be able to assist you at all, or complete the mandatory customer due diligence requirements to progress your transaction.
Collection Notices
When collecting your personal information, we will take reasonable steps to provide you with notice as required under the Australian Privacy Principles (APPs), including the purpose of collection, who we may disclose your personal information to, any law that requires or authorises us to collect the information and the main consequences if we do not collect the personal information we require.

our general business (including to conduct business functions including providing personal information to Harcourts Australia and other third parties, including our employees, contractors and service providers);

maintenance of our business records;

providing real estate agency services for the buying, selling, leasing, development and advertising of residential, commercial and rural properties, business broking, training and providing services in connection with arranging utility connection, removalists, cleaners, conveyancing, financing and insurance;
credit reporting bodies and tenancy database operators;
to comply with any law, rule or regulation, or decision of a regulator or Government authority, including AML/CTF laws and requirements that apply to us, Franchisees or service providers engaged in connection with the Harcourts franchise network; and
for purposes otherwise set out in this Privacy Policy.
We may disclose your personal information to:
Harcourts Australia and its related bodies corporate;
our related bodies corporate, other Harcourts Australia franchisees, agents, contractors, and business partners for the purposes set out above, and for the purposes of those parties providing services to us or performing business services or functions on our behalf;
other companies or individuals who assist us in providing services or who perform functions on our behalf (such as mailing houses, AML/CTF compliance providers, identity verification providers, hosting and data storage providers, specialist consultants and legal advisers);
other companies or individuals who perform checks (such as but not limited to compliance reviews and audits) that are required on our behalf;
other companies, agencies or individuals that maintain databases against which your identity may be verified;
social media sites on which we may have a presence;
courts, tribunals and regulatory authorities;
the Office of the Australian Information Commissioner;
any person or agency we believe could assist in responding to a serious privacy breach;
Australian Human Rights Commission, where a complaint relates to discrimination;
an overseas privacy regulator, where a complaint relates to the actions of an overseas agency;
Australian Communications and Media Authority, where a complaint or enquiry relates to the Spam Act 2003 (Cth); and
any person who we are required or permitted by law to disclose information to.
AML/CTF laws
We may collect, hold, use and disclose personal information to comply with AML/CTF laws and related compliance obligations. This may include collecting and handling identity information, government-issued identification details, copies of identification documents, information about beneficial ownership or control, source of funds or wealth information, transaction information and biometric information, where required or permitted by law.
We may use third-party service providers, including AML/CTF compliance providers and identity verification providers, to assist us with customer due diligence, identity verification, screening, audit, reporting, fraud prevention and related compliance purposes. This may also include verifying your identity using electronic identity verification services, including the Australian Government's Document Verification Service, and disclosing your personal information to government agencies, official record holders, regulators, law enforcement bodies and other persons where required or permitted by law.
Where biometric information is collected for identity verification or AML/CTF compliance purposes, we will collect it with your consent and handle it as sensitive information under the Privacy Act and as permitted or required by law.
Sensitive Information
We may only collect sensitive information (including information about your health, racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, trade union membership and criminal records) with your consent. We will use and disclose sensitive information for the purpose for which it was collected and as otherwise permitted by the Privacy Act and other applicable laws.
Storage and security of your personal information
We may hold your personal information in electronic formats or in hard copy. If your personal information is collected by our AML provider, its separate Privacy Policy applies. You may contact our office if you require information in relation to our AML provider.
We take reasonable steps to securely store your personal information to ensure it is protected from unauthorised access, modification and disclosure, and from other types of misuse, interference and loss. This includes electronic and physical security measures and procedures, staff training and use of password protection software.
We will take reasonable steps to destroy or permanently de-identify your personal information when we no longer require it for any purpose for which it was collected. We may retain your personal information for as long as necessary to comply with any applicable law, for legal, insurance and corporate governance purposes, and for the prevention of fraud and to resolve disputes. Your personal information may also be retained in our IT system back-up records.
